YourImageShare.com ("YourImageShare," "we," "us," or "our") operates an image and video hosting and sharing platform (the "Platform") provided free of charge. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and YourImageShare governing your access to and use of the Platform. By accessing, browsing, registering for, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform. We reserve the right to modify, amend, or update these Terms at any time and in our sole discretion, with or without prior notice. Any revisions become effective upon posting to the Platform, and your continued access to or use of the Platform following the posting of revised Terms constitutes your acceptance of and agreement to be bound by such revisions.

1. Content and User Responsibility

You may upload, publish, store, and share images, videos, and other materials (collectively, "Content") using the tools and functionality provided by the Platform. Content that you designate as public, or that is public by default, may be displayed in galleries, returned in search results, made available for embedding on third-party websites, or otherwise distributed through the Platform and its associated channels.

You are solely and exclusively responsible for all Content that you upload, publish, transmit, or distribute through the Platform, and for the consequences of doing so. You represent, warrant, and covenant that you own the Content or have obtained all rights, licenses, consents, releases, and permissions necessary to upload, publish, and distribute such Content and to grant the license set forth below, and that your Content does not infringe or violate the rights of any third party.

The Platform is not, and is not intended to function as, a backup, archival, or storage service. We do not guarantee the retention, preservation, or continued availability of any Content, and Content may be modified, restricted, or removed at any time, with or without notice and with or without cause. To the maximum extent permitted by applicable law, we assume no liability whatsoever for any loss, corruption, deletion, or unavailability of Content, for any interruption or discontinuation of service, or for the removal of any Content.

By uploading or submitting Content that is publicly accessible, you grant to YourImageShare a non-exclusive, worldwide, royalty-free, sublicensable, transferable, perpetual, and irrevocable license to host, store, cache, reproduce, distribute, publicly display, publicly perform, adapt, modify, translate, and create derivative works from such Content for the purposes of operating, providing, promoting, and improving the Platform. This license survives any termination of your account with respect to Content that has been shared, embedded, or distributed by third parties prior to such termination.

2. Prohibited Content

You agree that you will not upload, post, share, transmit, or otherwise make available through the Platform any Content that: violates any applicable law, statute, ordinance, or regulation; infringes, misappropriates, or otherwise violates any intellectual property right, privacy right, publicity right, or other proprietary right of any person or entity; constitutes, contains, or depicts child sexual abuse material (CSAM) or any sexual exploitation of minors; depicts non-consensual intimate imagery or otherwise violates the privacy or dignity of any individual; promotes, facilitates, glorifies, or incites terrorism, violent extremism, or any criminal activity; constitutes hate speech, harassment, bullying, intimidation, or threats against any individual or group; contains any virus, malware, worm, trojan horse, or other malicious or harmful code; or is fraudulent, deceptive, misleading, or intended to deceive or defraud any person.

We reserve the right, in our sole and absolute discretion, to determine whether any Content violates these Terms, and to take any action we deem appropriate, including removal of Content and suspension or termination of the responsible account.

3. Child Safety and CSAM Detection

YourImageShare maintains a zero-tolerance policy toward child sexual abuse material (CSAM) and any content that sexually exploits or endangers minors. We employ automated detection technologies, including image-hashing and matching systems, to identify, prevent the upload of, and remove such material from the Platform.

As a provider based in the United States, we comply with our legal obligations under 18 U.S.C. § 2258A. Where we obtain actual knowledge of apparent CSAM, we will preserve the relevant material and associated information as required by law, remove or disable access to it, and report it to the National Center for Missing & Exploited Children (NCMEC) through the CyberTipline, which may in turn refer such reports to law enforcement. We will terminate the accounts of, and where required cooperate with authorities regarding, any User involved in the creation, upload, or distribution of such material. Nothing in these Terms limits any action we may take, or any disclosure we may make, to comply with laws protecting minors.

4. Age Requirements

You must be at least eighteen (18) years of age, or the minimum age required to consent to the processing of personal data or to form a binding contract in your jurisdiction, whichever is greater, in order to access or use the Platform. If you are under the age of eighteen (18), you may use the Platform only with the involvement, consent, and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. We reserve the right to suspend or terminate any account that we reasonably believe does not meet these age requirements.

5. Copyright and DMCA Compliance

We respect the intellectual property rights of others and comply with the United States Digital Millennium Copyright Act, 17 U.S.C. § 512 (the "DMCA"), as well as comparable copyright frameworks in other jurisdictions. If you believe that Content available on the Platform infringes a copyright you own or control, you may submit a notice of alleged infringement through our official reporting form, available at yourimageshare.com/report, containing all information required under Section 512(c)(3) of the DMCA, including: (a) a physical or electronic signature of the copyright owner or authorized agent; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it; (d) your contact information; (e) a statement that you have a good-faith belief that the use is not authorized; and (f) a statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

Upon receipt of a valid and compliant notice of alleged infringement, we may remove or disable access to the material claimed to be infringing. Where applicable, the affected User may submit a counter-notification in accordance with Section 512(g) of the DMCA through the same reporting form. We maintain and enforce a policy providing for the termination, in appropriate circumstances, of the accounts of Users who are repeat infringers.

6. Repeat Infringer Policy

Consistent with applicable law, we maintain a policy of suspending or terminating, in appropriate circumstances and in our sole discretion, the accounts of Users who are the subject of multiple valid notices of infringement or who otherwise repeatedly infringe the intellectual property rights of others. All determinations regarding repeat infringement and the resulting enforcement action are made at our sole discretion.

7. Moderation and AI Systems

We may employ automated tools and technologies, including artificial intelligence, machine learning, and hash-matching systems, to detect, review, prioritize, restrict, or remove Content, whether alone or in combination with human review. Such automated moderation may result in the removal or restriction of Content or in action being taken against an account, including suspension or termination. Where required by applicable law or where we otherwise elect to provide it, Users may request human review of a moderation decision through the mechanisms provided on the Platform.

8. Accounts

You are responsible for maintaining the accuracy of your account information and for safeguarding the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate any account, with or without notice, for any violation of these Terms or for any other reason in our sole discretion. Accounts associated with an unverified email address may be removed within forty-eight (48) hours of registration. You may request deletion of your account by submitting a request through our contact form.

9. Reports and Platform Enforcement

Users and other parties may report Content that they believe violates these Terms or applicable law using our reporting form, available at yourimageshare.com/report. The submission of a report does not guarantee that any particular action will be taken, and we retain sole discretion over whether and how to respond to any report, except where applicable law requires a specific response. Formal legal notices, including notices of alleged copyright infringement and notices of illegal content, must be submitted through the reporting form in order to be considered.

10. Indemnification

You agree to indemnify, defend, and hold harmless YourImageShare and its owners, officers, directors, employees, affiliates, licensors, and agents (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or in connection with: (a) your access to or use of the Platform; (b) any Content you upload, publish, or distribute; (c) your violation or alleged violation of these Terms; or (d) your violation or infringement of any right of any third party, including any intellectual property, privacy, or publicity right. This indemnification obligation survives the termination of your account and these Terms.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Indemnified Parties be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Platform, whether based in contract, tort, negligence, strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, the total aggregate and cumulative liability of the Indemnified Parties arising out of or relating to these Terms or the Platform shall not exceed the greater of one hundred United States dollars (USD $100) or the total amount, if any, paid by you to us during the twelve (12) months immediately preceding the event giving rise to the claim. Where applicable law does not permit the exclusion or limitation of certain liabilities, our liability shall be limited to the maximum extent permitted by such law.

12. Disclaimer of Warranties

The Platform and all Content and services made available through it are provided on an "as is" and "as available" basis, without warranty of any kind. To the maximum extent permitted by applicable law, we expressly disclaim all warranties and conditions of any kind, whether express, implied, or statutory, including without limitation any implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Platform will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, or that any defects will be corrected.

13. Governing Law

These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or their formation shall be governed by and construed in accordance with the laws of the State of [INSERT STATE] and the applicable federal laws of the United States of America, without regard to conflict of law principles. Users who access the Platform from outside the United States do so on their own initiative and are solely responsible for compliance with all applicable local laws.

14. Dispute Resolution and Arbitration

Except where prohibited by applicable law, any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall be finally resolved by binding arbitration rather than in court, administered in accordance with the rules of a recognized arbitration body. The arbitration shall be conducted in the English language and shall take place in [INSERT STATE/CITY], United States. To the fullest extent permitted by applicable law, you agree to resolve disputes with us only on an individual basis and waive any right to participate in a class action, collective action, or representative proceeding. Nothing in this section deprives you of any right you may have under mandatory law to bring proceedings in a particular forum.

15. GDPR and Data Protection (EU/EEA Users)

If you are located in the European Economic Area, the United Kingdom, or another jurisdiction with comparable data protection laws, you may have certain rights with respect to your personal data under the General Data Protection Regulation (GDPR) and equivalent legislation, including the rights of access, rectification, erasure, restriction of processing, data portability, and objection to processing. You may exercise these rights by submitting a request through the contact mechanism identified in our Privacy Policy. We process personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

16. EU Digital Services Act (DSA) Transparency

In accordance with the EU Digital Services Act, we provide accessible mechanisms enabling Users and other parties to notify us of Content they consider to be illegal, available at yourimageshare.com/report. Content moderation decisions may be made through automated means, human review, or a combination of both. Users located in the European Union may request a review of moderation decisions affecting them through the mechanisms provided on the Platform, and we will provide a statement of reasons for such decisions where required by applicable law.

17. Australia Online Safety Compliance

We respond to valid removal notices issued under the Online Safety Act 2021 (Cth) and other applicable Australian online safety laws and regulations. Illegal or seriously harmful material that is reported to us under such laws may be removed or restricted promptly in accordance with our legal obligations.

18. China-Specific Compliance Notice

Users who access the Platform from within the People's Republic of China are responsible for complying with all applicable laws and regulations of the People's Republic of China. Content that is prohibited or restricted under applicable PRC law may be restricted or removed. We make no representation that the Platform is appropriate or available for use in any particular jurisdiction.

19. Consumer Law Protections

Nothing in these Terms operates to exclude, restrict, or modify any guarantee, right, or remedy that you may have under applicable consumer protection laws, including EU consumer protection law and the Australian Consumer Law, where such rights cannot lawfully be excluded, restricted, or modified. To the extent that any provision of these Terms is inconsistent with such mandatory consumer protections, those protections prevail to the extent of the inconsistency, and the remaining provisions of these Terms continue in full force and effect.

20. Cookies

We use cookies and similar technologies in accordance with our Privacy Policy in order to operate, secure, and improve the Platform and your experience. You may adjust your browser or device settings to refuse or disable cookies; however, doing so may limit or impair certain features and functionality of the Platform.
